Terms of Service
Last updated: 22 October 2026
These terms govern access to and use of the BolderBrain website and platform. Please read them before using the service.
Agreement to these terms
These terms govern your access to and use of bolderbrain.com and the BolderBrain platform. By accessing or using the service, you agree to these terms. If you use the service on behalf of an organisation, you represent that you have authority to bind that organisation.
If you have a separate signed agreement with us, that agreement takes precedence over these terms to the extent of any conflict.
The service
BolderBrain provides assessment, feedback, development, training and people analytics tools. We may add, change or remove features. We do not guarantee that the service will be uninterrupted, error-free or available at all times.
Some features may be labelled beta or preview. They may change or be withdrawn.
Accounts and security
You must provide accurate account information and keep it up to date. You are responsible for keeping your credentials secure and for all activity under your account.
Notify us promptly at [email protected] if you suspect unauthorised access. Organisation administrators control access, roles and permissions for their workspace.
Customer data and responsibilities
As between the parties, the customer organisation owns its data. We process customer data as a processor under our Data Processing Agreement.
The customer is responsible for having a lawful basis and providing notices to employees and candidates whose data is entered into the service. The customer must not upload unlawful, infringing or harmful content, or sensitive data that is not needed for the service.
We may suspend access if we reasonably believe there is a security risk, unlawful use or a breach of these terms.
Acceptable use
You must not:
- use the service unlawfully or to violate the rights of others;
- attempt to gain unauthorised access, probe or scan our systems, or interfere with the service;
- reverse engineer, copy, scrape or resell the service, or use it to build a competing product;
- upload malware or use the service to send spam;
- use the service to make automated employment decisions without human review.
Assessments are decision-support tools. The customer is responsible for employment decisions and for complying with employment law.
Fees and payment
Fees for paid plans are shown on the pricing page or in an order form. Payments are processed by Razorpay. By starting checkout, you authorise us and Razorpay to charge the amount shown.
You must accept these terms and our Privacy Policy at checkout. We record the version you accepted and the time of acceptance.
Unless an order form says otherwise, fees are payable in advance for the period shown at checkout. We do not automatically renew a plan unless the order form says so. Fees are exclusive of taxes unless stated, and you are responsible for applicable taxes.
Fees are non-refundable except where required by law or expressly stated in an order form. Nothing in these terms limits any rights you have under applicable consumer law. We may suspend paid features if payment is overdue.
Intellectual property
We and our licensors own the service, software, content, design and trademarks. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription or order term, subject to these terms.
The customer owns its data. The customer grants us a licence to host, process and display that data to provide the service. If you send us feedback, you grant us a non-exclusive, royalty-free licence to use it to improve the service.
Confidentiality
Each party will protect the other party's confidential information and use it only for the purposes of the agreement. Confidential information does not include information that is public, independently developed, or lawfully received from a third party.
Data protection
Our Privacy Policy explains how we handle personal data for our own purposes. Our Data Processing Agreement applies where we process personal data on behalf of a customer. The customer is responsible for its own notices and consents.
Third-party services
The service may integrate with third-party services such as Razorpay, AI model providers, HR systems, messaging platforms and analytics providers. Third-party services are governed by their own terms and privacy policies. We are not responsible for them except as required by law.
Disclaimers
To the extent permitted by law, the service is provided "as is" and "as available". We disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy and non-infringement.
Assessments and reports are not medical, psychological or psychiatric diagnoses, and they are not legal, financial or employment advice. AI-generated content may be inaccurate or incomplete. You should review it before relying on it.
We do not guarantee that the service will meet every requirement or that results will be error-free.
Limitation of liability
To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or business interruption.
To the extent permitted by law, our total liability arising out of or relating to the agreement is limited to the fees paid or payable by the customer in the 12 months before the event giving rise to the claim.
Nothing in these terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot be excluded by law.
Indemnity
To the extent permitted by law, the customer will indemnify us against claims, losses and costs arising from the customer's data, the customer's use of the service in breach of these terms, or the customer's failure to obtain necessary notices or consents.
Suspension and termination
We may suspend or terminate access if you breach these terms, fail to pay, create a security risk, or if required by law. You may stop using the service at any time. If you have a paid plan, termination takes effect at the end of the current paid period unless the order form says otherwise.
On termination, your right to use the service ends. You may request an export of your data before termination. We will return or delete personal data as described in the Data Processing Agreement and Privacy Policy.
Clauses that by their nature should survive termination will survive, including intellectual property, confidentiality, disclaimers, liability, indemnity and governing law.
Governing law and disputes
These terms are governed by the laws of India. The courts of India have exclusive jurisdiction, subject to any mandatory rights you have under the law of your country.
Before starting a formal claim, the parties will try in good faith to resolve the dispute through discussion.
Changes to these terms
We may update these terms from time to time. We will post the new version on this page and update the date. If changes are material, we will take reasonable steps to notify you. Continued use after the effective date means you accept the updated terms.
